Terms
1. Purpose
These General Terms and Conditions define
the rights and obligations of activity providers (“Provider”) and the company
operating the OddballTrip platform (“the Platform”), in the context of publishing,
booking, and promoting leisure activities.
2. Registration & Activity Listing
The Provider certifies that all information
shared about their activity is accurate, complete, and up to date. The Provider
is solely responsible for the published content (text, images, pricing, access
conditions). The Platform reserves the right to refuse or suspend any listing
that does not meet its selection criteria (originality, safety, legal
compliance, etc.).
3. Bookings, Payments & Commission
Customers book activities via the Platform
by paying a deposit that corresponds to the Platform’s commission (between 15%
and 20%). The remaining balance is paid directly to the Provider on the day of
the activity.
The Provider agrees to honor all confirmed bookings and must not charge
additional fees that were not clearly indicated at the time of booking.
4. Provider Responsibilities
- Offer services in accordance with the
published description.
- Respect the scheduled times and commitments.
- Inform the Platform promptly in case of unforeseen events or cancellations.
- Hold appropriate insurance for the activity (e.g., professional liability).
- Comply with local legal, tax, and social regulations in their country of
operation.
Additional Provider Tools and Responsibilities
Providers have access to a dedicated interface where they can manage their bookings. They may modify the time and date of a reservation or cancel it. If a Provider cancels two confirmed bookings, their listing will be automatically removed from the OddballTrip platform.
For greater convenience, Providers can connect their Google Calendar or Outlook Calendar to automatically sync their availability on the platform. This ensures that customers only book activities during available time slots.
Providers are responsible for checking their listings and must report any inaccuracies or errors to OddballTrip. They are fully accountable for maintaining accurate schedules and honoring all confirmed bookings.
5. Platform Responsibilities
- Promote the Provider’s activity across
its digital channels.
- Ensure visibility of the activity on the website.
- Provide technical support and assistance by email.
- Collect the commission without interfering with the payments between the
customer and the Provider.
6. Intellectual Property
The Provider guarantees they hold the
necessary rights for all texts, visuals, and branding elements associated with
their activity. The Provider grants OddballTrip permission to use these
elements for promotional purposes, while respecting their image and the intent
of the Platform.
7. Liability & Insurance
The Platform shall not be held liable for
any damages, disputes, accidents, or incidents occurring during the activity.
The Provider is solely responsible for delivering their service in full
compliance with local laws and safety standards.
8. Duration, Termination & Delisting
This collaboration is non-binding. The
Provider may request the removal or deactivation of their listing at any time.
The Platform may suspend or remove a listing in case of serious breach or
repeated negative customer feedback.
9. Disputes
In the event of a dispute between a
Provider and a customer, the Platform may act as a mediator, but cannot
guarantee refunds or compensation. Any legal dispute between the Platform and
the Provider shall be governed by the laws of the State of Wyoming, United
States, and resolved by the competent courts located in Wyoming.
10. Acceptance
By checking the acceptance box during
registration or continuing to use the Platform, the Provider confirms that they
have read, understood, and accepted these General Terms and Conditions.
